Bill for Divorce and Maintenance

And now on this day come the complainant by her Solicitors Ashcroft and Stillman and it appearing to the court here from the writ issued herein to the Sheriff of Fayette County and the return thereon that the defendant Heinrich Niehaus had been regularly served with process herein at least ten days prior to the first day of the present term of this Court and this cause coming on for a final hearing upon the bill of complaint herein the answer of the defendant Heinrich Niehaus and the oral testimony of witnesses sworn and examined in open court and the Court having heard the testimony of said witnesses and the arguments of Counsel and being fully advised in the premises and on consideration thereof doth find that all the material facts alleged in the said bill are true and that the defendant has been guilty of extreme and repeated cruelty toward the Complainant is manner and forum as charged in Complainants bill. It is therefore ordered adjudged and dicoud by the Court that the marriage between the Complainant and the defendant be dissolved and the same is hereby dissolved accordingly and the parties are and each of them is freed from the obligations there of. And the Court doth further order adjudge and decree that the defendant pay the Complainant the sum of Fifty Two Dollars ($52.00) during each and every year payable as follows Fifty Two Dollars on the 1st day of May 1883 Fifty Two Dollars on the 1st day of March 1884 and Fifty Two Dollars on the first day of March of each and every year thereafter until further ordered by this Court and that the defendant pay the costs of this suit to be taxed by the Clerk of this Court and that in default of the payment of any of said sums is the manner and at the times herein provided that executor issue therefore and that this decree shall be and remain a lien upon all the lands and tenements of the defendant for the payment of the several sums of money herein provided for. 6
